UNANIMOUSLY RESOLVED:
a. That the application for the deletion of restrictive title deed conditions B(b)(d)(e), as per Title Deed No T50263/2013, applied for in terms of Section 42(g) of the City of Cape Town Municipal Planning By-Law, 2015, in order to permit a ‘house shop’ and ‘plant nursery’ from existing structures in respect of Erf 35489, Kraaifontein, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law.
b. That the application for consent in terms of the Development Management Scheme, applied for in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015, in order to permit a ‘house shop’ in respect of Erf 35489, Kraaifontein, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, in accordance with Plan No 35489/16, subject to compliance with conditions contained in Annexure A.
c. That the application for permanent departure, applied for in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015, in order to permit the relaxation of the 3.5 m street building line to 0.0 m to permit the conversion of an existing store room into a house shop and lean-to-roof into a store room in respect of Erf 35489, Kraaifontein, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, generally in accordance with Plan No 35489/16, subject to compliance with the conditions contained in Annexure A.
d. That the application for temporary departure, applied for in terms of Section 42(c) of the City of Cape Town Municipal Planning By-Law, 2015, in order to permit a ‘plant nursery’ in respect of Erf 35489, Kraaifontein, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, in accordance with Plan No 35489/16, subject to compliance with the conditions contained in Annexure A.
B) APPROVAL FOR TEMPORARY DEPARTURE TO PERMIT A PLANT NURSARY ON THE PROPERTY – CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100(1) OF THE BYLAW IN RESPECT OF THE ABOVE CONSENT APPROVAL.
Condition 18 to be deleted.

The MPT APPROVED the application for the reasons set out in the Planners’ report.
