UNANIMOUSLY RESOLVED:
a. That the application for the subdivision of Erf 128750, Bonteheuwel BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the subdivision plan, attached as Annexure D, and subject to the conditions contained in the attached Annexure A.
b. That the application for consent use to permit a utility service (solid waste drop-off facility) on one of the subdivided portions on Erf 128750, Bonteheuwel BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law in accordance with the subdivision/site development plan, attached as Annexure C, and subject to the conditions contained in the attached Annexure A.
CONDITIONS IMPOSED IN TERMS OF SECTION 100 OF THE MUNICIPAL PLANNING BY-LAW
Environment and Heritage
Condition 8 to be amended as follows:
8. A Landscaping Plan for the development be submitted for approval to the Commissioner: TDA indicating the following:
New Condition:
• Appropriate screening measures be constructed along the entire perimeters of the site.
• An operational Environmental Management Plan be implemented.
REASONS FOR DECISION:
1. The property is ideally located and accessible to the local community for its intended use.
2. The facility will have a positive impact on the neighbourhood from a safety, health and well-being point of view.
3. From a visual perspective the proposal is desirable as the area will be cleaned-up and the facilities will be screened from view by means of landscaping.
4. Compliance with the requirements of the Waste Management License and the storing of waste material on the site for a period not exceeding 72 hours will mitigate potential health threats.
5. No detrimental impact on the traffic is foreseen as waste will be dropped off and loaded within the confines of the enclosed area and not along the street, while access to the property will be limited to one controlled access point.
