UNANIMOUSLY RESOLVED:
a) That an administrative penalty in terms of Section 129 of the City of Cape Town Municipal Planning By-Law; 2015 equal to R2068.00 (1%), be imposed for the unauthorized building work.
b) That an administrative penalty in terms of Section 129 of the City of Cape Town Municipal Planning By-Law; 2015 equal to R940.00 (1%), be imposed for the unauthorized land use activity on the property.
REASONS FOR DECISION:
1. The positive conduct of the applicant who immediately made an application to Council after being made aware of the unlawful status of the crèche.
2. There have been no complaints regarding the crèche.
3. The nature and scale of the activity has been of a low impact.
