RESOLVED UNANIMOUSLY

That a 1% administrative penalty in the amount of R3 078.00 be imposed in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 for the unlawful building work (extension to the dwelling) in respect of Erf 14188, 31 Wenthworth Close, Strand in accordance with plan no 14188/22/2015 dated 20/02/2015.

REASONS FOR DECISION:

1. The owner is fully responsible for unlawful building work. Aerial imagery shows that the structure was built around late 2015, thus making the duration of the contravention fairly short.
2. This is the owner’s first offence and he showed good faith and followed necessary steps once he was made aware of the contravention. This department is satisfied with his conduct.
3. The owner already has to deal with the unlawful building work in terms of the National Building Regulations in court.
