RESOLVED UNANIMOUSLY

That it BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, to impose an administrative penalty in the amount of R2 530 (rounded off), representing 5% of the value of the building/construction work, 20m2 in extent, which is encroaching into the road reserve on Erf 425, Beach Road, Gordon’s Bay and which is being utilised for restaurant outside seating purposes.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planners’ report.
