Resolution details

UNANIMOUSLY RESOLVED that:

a) The application for consent in terms of Item 21(c) of the Development Management Scheme, to permit the rooftop base telecommunication station on Erf 4555 Kommetjie, BE REFUSED in terms of section 98 of the Municipal Planning By-Law, 2015.

b) The application for departures from the Development Management Scheme, as set out in Annexure A, on Erf 4555 Kommetjie, BE REFUSED in terms of Section 98 of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. It is clear that there are existing habitable structures within the 50m exclusion zone at a similar height to the proposed antenna, thereby not complying with requirements of Council’s 2015 Telecommunication Mast Infrastructure Policy as set out in paragraph 7.7 of the Planners’ report
2. The proposal could thus have negative health impacts and does not comply with the desirability criteria in Section 99 of the Municipal Planning By-Law, 2015, in so far as the “impact on safety, health and wellbeing of the surrounding community” is concerned
