UNANIMOUSLY RESOLVED that:

a. An administrative penalty in the amount of R 0.00 IS APPROVED in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 40413 Cape Town in accordance with DRW No. N/M Penlyn May 2016, drawn by GM3 Designs & Architecture Pty LtD, dated 26th May 2016.
REASONS FOR DECISION:

1. The unauthorised building work was built by the previous owners and the current owners purchased the property in 2013 with the contraventions.
2. As far as can be ascertained the owners of the property have not previously contravened the Municipal Planning By-Law or any other planning law.
3. An application for departures was submitted in order to rectify the situation once the current owners became aware of the unauthorised building work on their property.
