UNANIMOUSLY RESOLVED that:
a. An administrative penalty in the amount of R 40 000.00 IS APPROVED in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 148345 Cape Town at Diep River, with regard to the plant nursery.
REASONS FOR DECISION:
1. The use of the property as a plant nursery is in contravention of Item 21 of the Municipal Planning By-Law.
2. The nature of the contravention is low key and the gravity is not serious.
3. The property owner appears to have been aware of the contravention but went ahead anyway.
4. As far as can be ascertained, the person involved in the contravention has not previously contravened this By-Law or any other planning law.
