UNANIMOUSLY RESOLVED that:

a. An administrative penalty in the amount of R 29 114.47 IS APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law 2015, in respect of Erf 160711 Cape Town, in accordance with plan AJ/160711 (pages 1 – 3) dated 03.05.2015 drawn by M Sexton

REASONS FOR DECISION

1. The scullery, bedroom, family room and carports are unauthorized and contravene the Municipal Planning By-Law 2015
2. The nature of the contravention is relatively large in relation to the property size
3. The owner misled the officials, stating that he already paid a fine
4. According to the owner, he acted in good faith and left the issue of the building plan to the builder
5. The gravity of the contravention is extensive
6. As far as can be ascertained, the owner of the property has not previously contravened this By-Law or any previous planning law.
