UNANIMOUSLY RESOLVED that:
a. An administrative penalty in the amount of R 9 358.60 (10%) IS APPROVED in terms of section 129 of the City of Cape Town Municipal Planning Amendment By-Law, 2016 in respect of Erf27480, 77 Mthawelanga Street, Ilitha Park, Khayelitsha
REASONS FOR DECISION:
1 Safety and well-being of the surrounding community is currently being jeopardized by the activity.
2 No record could be found of previous contraventions of the By-Law or of the planning law.
3 The applicant has taken the necessary steps to regularize the unauthorized tavern operating from a portion of the subject property.
