Resolution details

UNANIMOUSLY RESOLVED that:

a) The application to remove the title deed condition set out in attached Annexure A in terms of Section 42(g) of the Cape Town Municipal Planning Bylaw, 2015 IS APPROVED in terms of Section 98 of the Cape Town Municipal Planning Bylaw, 2015.

REASONS FOR DECISION

1 The proposal complies with the minimum threshold requirements set out in Section 99(1) of the Cape Town Municipal Planning By Law. All relevant considerations set out in Section 99(2) of the said By Law have been considered in the evaluation and the proposal is considered to be desirable in terms of Section 99(3) of the said By law.
2 The proposal complies with approved City Policy as the proposal will facilitate mixed use development and active streetscape in close proximity to public transport.
3 The proposed removal of the title deed restriction will have no adverse impacts on the holder of property rights and no legitimate expectations will be materially or adversely affected by the proposal. The proposed removal of the title deed restriction is considered to be desirable and in conformance with City policy as it will facilitate mixed use development and economic revitalization in the activity corridor close proximity to public transport.
