UNANIMOUSLY RESOLVED that:
a. The application for consent, as set out on Annexure A, for Erf 1892 Pinelands IS APPROVED in terms of 98 of the Municipal Planning Bylaw, subject to the conditions contained in Annexure A.
b. The application for deletion and amendment of title deed conditions, as set out on Annexure A, for Erf 1892 Pinelands IS APPROVED in terms of 98 of the Municipal Planning Bylaw, subject to the conditions contained in Annexure A.
c. The application for departures, as set out on Annexure A, for Erf 1892 Pinelands IS APPROVED in terms of 98 of the Municipal Planning Bylaw, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
1. The proposal complies with Section 99(1) and 99(3) of the MPBL.
2. The proposal complies with Section 39(5) of the Land Use Planning Act.
3. The City’s Spatial Development Framework policy supports such facilities close to threshold populations.
4. The proposal complies with the aspects of the Early Childhood Development Land Use Policy.
5. The staggered start and finish times help to limit impacts on the surrounding properties and road.
6. Conditions have been imposed to mitigate the impact of the proposal on the surrounding area (including number on children, hours of operation and staff numbers).
