RESOLVED that:
a) The application for consolidation and departures, as set out in Annexure A, on Erf 896 and remainder Erf 897 Green Point IS REFUSED in terms of the Municipal Planning By-Law.
REASONS FOR DECISION
Reasons for the recommended decision for refusal may be summarised as follows:
1. Non-compliance with requirements of Section 99(3) in as far as
compatibility with the surrounding uses, traffic impacts resulting from the proposed development, not being in proportion with the surrounding buildings in Scholtz Road and the scale and design created from the consolidation is not considered to be desirable
2. The consolidation will allow the creation of a building of which the massing
and scale will negatively impact on the surrounding area and Scholtz Road, which is a short cul-de-sac
3. The cumulative impact of the consolidation on the development rules
allows for the creation of a development that will have an undesirable impact on the local context.
4. The consequence of consolidation and increased site extent will result in
significantly more dwelling units and parking bays which are not appropriate within the local context.
5. The applicant has failed to provide substantive motivation for the
consolidation and of its desirability
