Resolution details

RESOLVED that:

a) The application for the removal and amendment of title deed conditions, as set out in attached Annexure A, in respect of Erf 1169 Camps Bay, IS APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to conditions in Annexure A attached.


REASONS FOR DECISION


1. The application complies with the minimum threshold requirements of Section 99 of the Municipal Planning By-law.
2. The application is consistent with the Table Bay District Plan, Densification Policy and Municipal Spatial Development Framework
3. The application is desirable as it would result in a built form which is not discordant with neighbouring residential area. Conditions are proposed to ensure that development is in keeping with the character and prevailing built form.
4. Minimal, if any, adverse impacts in the area will be effected.
5. Removal of restrictive title deed conditions would not cause development at odds with the area.
6. The amendment of the one dwelling restrictive condition to allow for four flats will be in the public interest.
7. The built form of the area will not be unacceptably altered.
8. The MPT has had regard to Section 39 of the Land Use Planning Act, Section 47 of the Spatial Planning and Land Use Management Act and Section 25 of the Constitution.
9. Restrictions have been placed on the Conditions in that the development will be governed by rules for a dwelling house in an SR1 zone to ensure positive benefit to the broader environment
