UNANIMOUSLY RESOLVED
8.1 The consolidation of erven 37460 and 37461, Bellville, BE APPROVED in terms of section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law (2015), subject to the conditions enumerated in annexure A;
8.2 The rezoning of the consolidated erven 37460 and 37461, Bellville, from Single Residential Zoning 1: Conventional Housing to Subdivisional Area Overlay Zone, BE APPROVED in terms of section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law (2015), subject to the conditions enumerated in annexure A;
8.3 The subdivision of the consolidated erven 37460 and 37461, Bellville into 21 General Residential Subzoning GR2 erven and the remainder Open Space Zoning 3: Special Open Space (OS3) (private road), as per annexure C, BE APPROVED in terms of section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law (2015), subject to the conditions enumerated in annexure A;
8.4 The permanent departures from the Development Management Scheme (DMS) in respect of the consolidated erven 37460 and 37461, Bellville to permit the following relaxations:
8.4.1 Relaxation of the 4,5m street building line (Gamay) to 3,5m;
8.4.2 Relaxation of the common boundary building line from 4,5m to 3m; and
8.4.3 Relaxation of the street building line on Van Riebeeckshof Road from 5m to 3,5m.
…BE APPROVED in terms of section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law (2015), subject to the conditions enumerated in annexure A
8.5 The amendment of condition 2.1.2 of the approval dated 3 July 1998 (with reference AF01/27/18/3/42) to include the development of the consolidated erven 37460 and 37461, Bellville, for general residential purposes, be approved BE APPROVED in terms of section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law (2015), subject to the conditions enumerated in annexure A.
8.6 The proposed street name, namely Gamarat, in respect of the development on the consolidated erf 37460 and 37461, Bellville BE APPROVED in terms of the System of Delegations, as depicted on the subdivision plan attached as annexure C.
REASONS FOR DECISION:
1. The proposal is aligned with policy directive 22 of the Cape Town Spatial Development Framework as the proposed development is considered as appropriate densification (refer paragraph 6.1.1 of this report).
2. The proposal is compliant with the Densification Policy statements 1, 2, 5 and 6 as it is considered as small scale, incremental densification which provides for a variation in housing options in close proximity to public open space (refer paragraph 6.1.3 of this report).
3. The integrity of the Oude Westhof suburb will not be compromised considering the specific context, the proposed design and considering that intended use will remain residential in nature.
4. The proposed departures are not considered to pose a threat to the integrity of the streetscape or greater character. This is considering the proposed coverage, floor factor, height and design elements which adhere to the City of Cape Town Urban Design Policy (refer paragraph 6.2 of the report).
5. The consolidation is not considered to be out of scale nor is it considered to have a detrimental impact on the surrounding properties (refer paragraph 6.5 of the report).
