UNANIMOUSLY RESOLVED
a) That the application for a Consent Use on Erf 85, 111 Kendal Road, Eversdale, Bellville, for a Place of Instruction to accommodate a swim school on the property concerned, as indicated on the Site Development Plan No C-1001 dated 27 April 2016 attached as Annexure C, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law subject to the conditions contained in the attached Annexure A.
REASONS FOR DECISION:
1. The swim school is considered to be compatible with the surrounding area and the vision in terms of the Northern District Plan as the proposal retains the residential character of the area.
2. With the operation of the swim school, the use of the property would still predominantly remain residential in nature and the influence it would have on the surrounding area would be minimal.
3. The impact of a swim school, with maximum four children and hence a small-scale business, is not deemed to be a threat to the existing rights or well-being of the community and is unlikely to have a negative impact on the surrounding owners.
4. Adequate parking is provided in a form that is supported by the City’s Transport for Cape Town Department.
5. Sufficient infrastructure exists to support the development proposal.
6. The proposal is consistent with planning policy (i.e. the Northern District Plan, Economic Growth Strategy and Social Development Strategy).
7. The proposed development will not have an adverse impact on traffic movement, considering the relatively small scale of the development and its proximity to major movement routes.
8. Noise disturbance would not be prevalent as the conditions of approval would strictly prohibit any disturbance, be it noise or otherwise as the pool is within an enclosed structure.
