UNANIMOUSLY RESOLVED

a) That the application for a Consent Use on Erf 1048, 10 Van Der Westhuizen Avenue, Durbanville, to accommodate a Guest House with five lettable rooms on the property concerned, as indicated on the Site Development Plan dated 03.05.2016 attached as Annexure C, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law subject to the conditions contained in the attached Annexure A.

REASONS FOR DECISION:

1. The proposal for a guesthouse with five (5) bedrooms is deemed compatible with the existing character of the area.
2. With the operation of the guesthouse, the use of the property would still remain residential in nature and the impact it would have on the surrounding area would be minimal. The proposed guesthouse is thus not deemed to have a negative impact on the residential amenity of the surrounding properties.
3. The impact of a five bedroom guesthouse and hence a small-scale residentially orientated business is not deemed to be a threat to the existing rights or well-being of the community and is unlikely to have a negative impact on the surrounding owners.
4. Adequate parking is provided in a form that is supported by the City’s Transport for Cape Town department.
5. Sufficient infrastructure exists to support the development proposal.
6. The proposal is consistent with planning policy (i.e. the Northern District Plan, Guest Accommodation Policy, Economic Growth Strategy and Social Development Strategy).
7. The proposed development will not have an adverse impact on traffic movement, considering the relatively small scale of the development and its proximity to major movement routes.
8. The proposed use will not impact negatively on the health, safety and wellbeing of the surrounding community.
9. With the operation of the guesthouse, safety and security would be enhanced, as the owner/caretaker would need to ensure that a protected environment is maintained for the attraction of potential guests.
10. Noise disturbance would not be prevalent as the conditions of approval would strictly prohibit any disturbance, be it noise or otherwise.
