RESOLVED

a) The application for permanent departure to permit the erection of dwelling additions on Erf 7325, Brackenfell, BE APPROVED in terms of section 98(b) of the Municipal Planning By-Law 2015, as illustrated on plan ENG005 DATED 12-04-2015, attached Annexure C, subject to conditions to be circulated to the current panel members for acceptance.

CONDITION TO BE IMPOSED IN TERMS OF SECTION 100 OF THE CITY OF CAPE TOWN MUNICIPAL PLANNING BY-LAW, 2015

1. Must be Compliant with Annexure C.
REASONS FOR DECISION:

1. Notwithstanding the current title deed restriction the Tribunal is of the opinion that the removal of such title deed restriction would in fact be in the public interest with limited if any impact on the public or private realm
2. The relaxation of the street building line will not impact negatively on surrounding properties or negatively affect existing rights.
3. The proposal is considered to result in a positive social impact, in that housing accommodation is being provided
4. The proposal will improve surveillance onto the street.

5. The scale of the design is consistent with the development potential of the site.
6. The application is considered to be desirable.
