UNANIMOUSLY RESOLVED
a) The application for section 42 (a) – Rezoning in respect of Erven 10301 & 10289, Bellville, from Single Residential to general Business 4 BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, to permit parking for business purposes in accordance with the site plan no R-001, attached as Annexure I, subject to the conditions, attached as Annexure A.
b) The application for Section 42 (f) – Consolidation of land in respect of Erven 10300, 10301 & 10286, Bellville BE APPROVED in terms of section 98 (b) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the site plan no R-001, attached as Annexure J, subject to the conditions, attached as Annexure A.
c) The application for Section 42 (i) – Special Consent to allow parking bays closer than 10m to a street boundary in respect of Erven 10300 and 10301, Bellville, BE APPROVED in terms of section 98(b) of the City of Cape town Municipal Planning By-Law, 2015, in accordance with the site plan no R-001, attached as Annexure I, subject to the conditions, attached as Annexure A.
d) The application for Section 42 (b) – Permanent Departure from the site access requirement of three existing carriageway crossings less than 12m apart from another to the property in respect of Erven 10300, 10301 & 10286, Bellville, BE APPROVED in terms of section 98(b) of the City of Cape Town By-Law, 2015, in accordance with the site plan no R-001, attached as Annexure I.
e) The application for Section 42 (b) – Permanent Departure from the site access requirement of three carriageway crossings to the property in respect of Erven 10300, 10301 & 10286, Bellville, BE APPROVED in terms of section 98(b) of the City of Cape Town By-Law, 2015, in accordance with the site plan no R-001, attached as Annexure I.
REASONS FOR DECISION:
1. The proposal will not have a negative impact on the property rights of surrounding property owners as it is already in operation.
2. The proposed parking, access and egress arrangements comply with the requirements of the departmental TCT: Integrated Transport Planning.
3. The proposal is in line with the forward planning initiatives as described in the Tygerberg District Plan, which earmarks the area for mixed use development.
