UNANIMOUSLY RESOLVED

a) That the application for Consent Use in respect of Erf 2710, Kuilsrivier, to allow for the operation of a place of instruction (ballet school) for 40 children, BE APPROVED in terms of section 98(b)(iii) of the CoCT Municipal Planning By-Law, 2015 in accordance with the Site Plan No. KU.2710 dated 08-12-2014, attached as Annexure C and C1, subject to conditions as stipulated in Annexure A.

AMENDED CONSENT USE CONDITIONS OF APPROVAL IN TERMS OF SECTION 100 OF THE CITY OF CAPE TOWN MUNICIPAL PLANNING BY-LAW, 2015

Condition 2 to be amended as follows:

2. “That a maximum of 40 children shall be accommodated at the Ballet school at any one time.”

REASONS FOR DECISION:

1. The nature and extent of the proposed ballet school, located along the higher order “Kerk Street”, opposite and in close proximity to De Kuilen Primary and Secondary schools, would relate to surrounding land uses and the existing character of the area.
2. With the implementation of a noise management plan, including noise mitigation measures, as well as the proposed restricted operating hours, as imposed as conditions of approval, it is not likely that the proposed ballet school will cause a significant noise nuisance or impact on the surrounding owner’s rights and enjoyment of their properties.
3. The proposed site access and on-site parking arrangement, as accepted by TCT: Integrated Transport is sufficient and not likely to essentially affect existing traffic conditions in Kerk Street.
4. Sufficient service capacity exists for the proposed use and all service departments support the proposal.
