UNANIMOUSLY RESOLVED
a) The application for the removal of restrictive title deed conditions (condition B, clause 4 and 5) to permit shops on the property, BE APPROVED in terms of section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.
b) The application for regulation departure in respect of Erf 9774, Goodwood to permit the relaxation of the 5.0m statutory street (Halt Road) building line to 0.0m and the 8.0m setback from the centre line of the road to 5.743m to permit shops on the property, BE APPROVED in terms of section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance to the Site Layout Plan attached as Annexure C, subject to the conditions contained in Annexure A.
REASONS FOR DECISION:
1. The proposed development would not adversely impact on any existing rights in terms of overlooking, overshadowing or obstruction of primary views.
2. The proposal is unlikely to have any adverse impact on the amenity of the area or on the general aesthetic character of the streetscape in this area.
3. The proposed removal of the restrictive title deed will not have any adverse impact in terms of existing rights of the property owners in the area.
4. The removal of the restrictive title deed condition will not result in any financial or personal loss to the abutting neighbours or the applicant.
