UNANIMOUSLY RESOLVED
a) That the application for Consent Use in respect of Erf 8519, Bellville, to allow for the operation of an aftercare caring for 30 children, BE APPROVED in terms of section 98(b)(iii) of the CoCT Municipal Planning By-Law, 2015 in accordance with the Site Plan attached as Annexure C, subject to conditions as stipulated in Annexure A.
AMENDED CONSENT USE CONDITIONS OF APPROVAL IN TERMS OF SECTION 100 OF THE CITY OF CAPE TOWN MUNICIPAL PLANNING BY-LAW, 2015
Condition 5 to be amended as follows:
5. That the hours of operation of the aftercare shall be limited and restricted to 13H00 till 18H00 Mondays to Fridays.
Condition 7 to be added:
7. The aftercare shall not operate during December/ January holiday period.
REASONS FOR DECISION:
1. The proposed on-site parking arrangements are considered sufficient and functional, with a minor short-fall of one on-site parking bay as per requirement is not considered significant.
2. That the area indicated on the site plan is considered adequate to accommodate the proposed number of 30 children.
3. It is considered that the activity is minor is scale and limited in terms of hours of operation and will therefore have very little impact on the existing rights of abutting property owners in terms of noise, nuisance and general traffic related problems.
4. The demand for such an after-care facility in the immediate vicinity of two schools, has been well motivated.
5. Positive social benefit is considered desirable.
