UNANIMOUSLY RESOLVED
a) That the application for an order for payment of an administrative penalty, applied for in terms of section 129(3) of the Municipal Planning Bylaw (2015), for an amount of R2 600.30 (i.e. 5%) in respect of the existing unlawful land use (house shop) on Erf 6827, Kraaifontein, as indicated on Site Layout Plan no 6827/16 (see Annexure B), BE APPROVED in terms of Sections 98(b) and 129(1A)(a-b) of the same bylaw.
REASONS FOR DECISION:
1. No proof of extenuating circumstances was provided by the applicant to warrant the commencement of operation of the house shop, without prior approval from the City in terms of relevant legislation.
2. The contravener did not attempt to rectify the contravention by applying for determination of the administrative penalty.
3. They were served with a notice and did not respond.
4. They failed to provide truthful information, therefore their conduct were unacceptable.
