Resolution details

a) The Municipal Planning Tribunal South-western Panel APPROVES the application for departure of erf 39340, Cape Town at Belthorn Estate, to permit a garage extension of 0,0m in lieu of 1,5m from Orange Street, in terms of Section 98 of the Municipal Planning By-Law in accordance with Drawing no. 05/15 dated 06.05.2015;

b) The Municipal Planning Tribunal South-western Panel APPROVES The application for departure of erf 39340, Cape Town at Belthorn Estate, to permit a second dwelling 0,0m in lieu of 3,0m from North common boundary, in terms of Section 98 of the Municipal Planning By-Law in accordance with Drawing no. 05/15 dated 06.05.2015;

c) The Municipal Planning Tribunal South-western Panel APPROVES The application for departure of erf 39340, Cape Town at Belthorn Estate, to permit a second dwelling 0,0m in lieu of 3,0m from East common boundary, in terms of Section 98 of the Municipal Planning By-Law in accordance with Drawing no. 05/15 dated 06.05.2015.

REASONS FOR DECISION


1. The proposal is consistent with the Municipal Spatial Development Framework, Southern District Plan, the Cape Town Densification Policy and the Urban Design Policy.
2. The proposal will have a positive economic impact in the area as
improvements to the property will increase market value.
3. The proposal is considered compatible with the surrounding residential erven.
4. The proposed garage extension compliments the design of the
existing dwelling.
5. No negative impact is expected on the safety, health and well-being of the
surrounding community.
