a) The Municipal Planning Tribunal South-western Panel APPROVES an administrative penalty in the amount of R 3 000.00 equal to 5% in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 101352, Cape Town in accordance with plan no SENE 027.
REASONS FOR DECISION
1. The 1st storey has been constructed without Development Management Scheme compliance (and without an approved building plan) and the gravity of contravention is considered as serious.
2. As far as can be ascertained, the owner of the property has not previously, other than this, contravened this By-Law or any other planning law
3. The owner has ceased building and shown good faith in the administrative penalty process.
