a) The Municipal Planning Tribunal South-western Panel APPROVES an administrative penalty in the amount of R1 100.00 in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Remainder Erf 59868 Cape Town at Lansdowne in accordance with plan no RW 03/0216, Rev. A, dated February 2016.

REASONS FOR DECISION:

1. The nature of the contravention is relatively low key and of moderate gravity.
2. As far as can be ascertained the owner of the property has not previously contravened the Municipal Planning By-Law or any other planning law.
3. The duration of the contravention is longer than as indicated by the applicant.
