Resolution details

a) The Municipal Planning Tribunal South-western Panel APPROVES the application for the amendment and deletion of conditions in respect of an existing approval for erf 172536 Cape Town at Rondebosch (unregistered consolidation of erven 46868 and 46869), as set out in Annexure A attached to the departmental report dated 2016-10-19, in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to additional conditions as set out in Annexure A attached to the departmental report.

b) The Municipal Planning Tribunal South-western Panel APPROVES the application for departures, as set out in Annexure A attached to the departmental report dated dated 2016-10-19, for erf 172536 Cape Town at Rondebosch (unregistered consolidation of erven 46868 and 46869), in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.


REASONS FOR DECISION

1. The proposal is of an appropriate scale and form that relates to the
broader urban fabric.
2. The proposal is not inconsistent with the character of the wider area and
will not have a negative impact on neighbouring properties.
3. The level of densification proposed is contextually appropriate.
4. The proposal is consistent with the Municipal Spatial Development Framework; Southern District Plan, the Cape Town
Densification Policy and the Urban Design Policy.
5. Adequate on-site parking will be provided and the proposal will not have a
negative impact on traffic.
6. The proposal will not have a negative heritage impact.
7. There is adequate infrastructural capacity for the proposal.
8. The proposal will not have a negative socio-economic impact.
9. The proposal will not have a negative impact on the streetscape.
10 The proposal is desirable and does not impact on existing rights.


FUTHER RESOLVED

That an additional condition be added as follows:
The design of the building shall be to the satisfaction of the Executive Director Energy, Environmental and Spatial Planning (EESP) in which the Urban Design Branch is approached for comment.
