UNANIMOUSLY RESOLVED That the granting of rights to the applicant, Silver Creek Spur, 7 Pampoenkraal Lane, Durbanville, or their successors in-title, BE APPROVED, subject to the inter alia the following conditions: (a) At a market rental as proposed by the Valuations Branch as reflected on agenda pages 354 and 355 (R45 per m2), with an 8% escalation per annum from the date of the valuation, i.e. as from 31 July 2018 (b) The lease will endure for a period of three (3) years (c) The property will be used for the purpose of tables and chairs only (d) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority (e) Subject to compliance with any other statutory requirements (f) No compensation will be payable for any improvement made to the property (g) All outstanding accounts with the City of Cape Town must be settled (h) This approval does not automatically include the extension of the liquor licence(s) area and extension of liquor trading hours and separate applications in accordance with the provisions of the Liquor Act and City of Cape Town Control of Undertakings that Sell Liquor to the Public Bylaw, 2013 must be submitted. (i) That the Dept of Property Management BE REQUESTED to study the legal opinion which is attached to the minutes as an official annexure to ensure that future applications are correctly assessed.
