UNANIMOUSLY RESOLVED that:
a. The application for erf 1239-RE, Ottery, for amendment of condition 1.2 (File ref 15/6/2/14/1239) to permit an access way of 7,5m on Shaftesbury Road BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for erf 1239-RE, Ottery, for amendment of condition 1.2 (File ref 15/6/2/14/1239) to permit a maximum height of three-storey residential flats, not exceeding 10.5m in height, with the exception of units 41-44 on Layout Diagram 3.1 dated October 2018, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. The departure application for erf 1239-RE, Ottery to permit buildings to be located 2,14m in lieu of 5,0m from Old Strandfontein Road BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

d. The application for erf 1239-RE, Ottery for the approval of a Site Development Plan BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.
Amend Annexure A:
3.1.1 A maximum number of 51 residential units shall be permitted on the site.
3.1.2 An amended SDP shall be submitted for approval reflecting the following:
- Relocation of units 41-44 away from the north boundary to the south boundary on Layout Diagram 3.1 dated October 2018.
- Omission of balconies of units 24-27 on Layout Diagram 3.1 dated October 2018
Note: The SDP shall be in accordance with Urban Design Policy.

3.2.8 The unsurfaced sidewalk on the western side of Old Strandfontein Road must be upgraded to a 2.0m formalized surfaced sidewalk between York Road and Saratoga Road.

3.3.2 The owner shall pay a financial contribution of R 1 200 113. 49 towards the provision of bulk civil engineering services, in accordance with the set relevant policy. Such payment shall be made prior to final building plan approval.
