UNANIMOUSLY RESOLVED that:
a. The application for a deletion of restrictive title deed conditions, as set out in Annexure A, for Erf 59 Knole Park, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for a deletion of a condition of an existing approval, as set out in Annexure A, for Erf 59 Knole Park BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for rezoning from Rural to Subdivisional Overlay Zone for General Residential GR2 and Utility Zone for Erf 59 Knole Park BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The application for subdivision of Erf 59 Knole Park BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision KP59/03 dated April 2016, subject to the conditions contained in Annexure A.
e. The application for a permanent departure, as set out in Annexure A, for Erf 59 Knole Park BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:
7.1.4 The proposal will not have a significant negative impact on the biophysical environment.
7.1.7 The proposal will have a positive visual impact on the streetscape.
Amend Annexure A:
2.1.1 bullet point 5:
- Formal landscaping plan including treatment of all parking areas to provide multi-functional uses (including play areas) and, where possible, the creation of small open space areas and storm water facilities
Add new bullet point 7:
Boundary treatment
2.3.7 A minimum 1.5m (1.8.m preferred) pedestrian sidewalk to be implemented along Ottery Road from the Williston intersection, down Boundary Road, along Koan Road. All costs involved are to be borne by the developer.
2.3.8 the word ‘tapper’ was corrected to ‘taper’ in the first and second bullet under this condition.
