UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 1 000.00 for the unauthorized building work, BE DETERMINED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of 1290, 1 Terantaal Street, Macassar.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 2:
The unlawful structure is constructed over a municipal sewer pipe which impacts negatively on the maintenance of engineering services. The gravity of the transgression can thus be deemed serious.
