RESOLVED TO RECOMMEND Subcouncil 20 supports the recommendation of the lease of portion of City Land, being a portion of Erf 12534, Constantia situated at corner Ou Kaapse Weg and Steenberg Road, shown hatched and lettered ABCDEFG on attached sketch LT 1342v1 marked annexure A, in extent approximately 927m², to Steenberg Homeowners’ Association, or its successors in title, be approved subject to inter alia the following Conditions, that; a) A market rental of R11 500.00 per month inclusive of rates and excluding VAT calculated at the rate applicable at the time of transaction be payable; b) The monthly rental is to be adjusted on the basis of 8% per annum compounded annually commencing from the date of this valuation. Accordingly, the above recommended rental is effective and payable as from 2018-01-01; c) The lease will endure for a period of 10 years; the rental to be reviewed after 5 years, subject at any time to TWO MONTHS notice of termination. d) The land shall be used for balancing reservoir/dam connected to the supply pipeline conveying treated effluent water from the Cape Flats Treatment Works at Strandfontein to serve Westlake Golf Club and Steenberg Estate purposes only and no structures other than the existing structures will be permitted within the lease area; e) Subject to such further Conditions to be imposed by the Director: Property Management in terms of the delegated authority; f) Subject to compliance with any other statutory compliance; g) No compensation will be payable for any improvement made to the property. h) Adherence to the requirements of the City of Cape Town’s By–Laws. i) No electricity services exists within the proposed lease area but the following Conditions will apply; j) Any altercations or deviations to the electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost. k) Telkom services exist within the proposed lease area and the following conditions are to apply; l) It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan; m) It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; n) The reservoir shall have a fixed lid to the satisfaction of the City of Cape Town. o) The water shall be odourless and shall not be harmful to the City of Cape Town employees working on or on standby at the abutting property; p) The reservoir shall be screened off as much as possible with indigenous vegetation to the satisfaction of Recreation and Parks; q) The work shall be partially recessed below the ground to the satisfaction of Environmental Resource Management; r) No indigenous vegetation shall be damaged or removed; s) No access shall be permitted through the Environmental Resource Management depot adjacent to the lease land; t) Access shall be taken through a small pedestrian gate situated along the line marked BCD on the attached plan and shall be to the satisfaction of the Environmental Resource Management Directorate; u) No compensation will be payable for any improvements made to the property, with or without the consent of the Council, should the lease be terminated for any reason whatsoever.
