UNANIMOUSLY RESOLVED that:
1. The application for amendment of the approved Site Development for Rem Erf 7872, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
2. The application for a regulation departure from the DMS for Rem Erf 7872, Somerset West, to permit a carriageway crossing of 5m in lieu of 4m on Caledon Street, as indicated on plan no 04059-ssw7872-rev 00 sheet 2 dd March 2018, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
3. The application for a regulation departure from the DMS for Rem Erf 7872, Somerset West, to permit a carriageway crossing of 18,5m in lieu of 8m on Huising Street for 90° embayment parking bays, as indicated on plan no 04059-ssw7872-rev 00 sheets 1 & 2 dd March 2018, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
4. The application for a regulation departure from the DMS for Rem Erf 7872, Somerset West, to permit vehicles to reverse over the footway on Huising Street, as indicated on plan no 04059-ssw7872-rev 00 sheets 1 & 2 dd March 2018, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

15 That the Developer/Owner must negotiate with the owners of lower-lying erven 11447 and 7745 in order to drain the stormwater runoff from higher-lying erf 7872 through their properties, prior to building plan approval
