UNANIMOUSLY RESOLVED that:
a. The application for the amendment of restrictive title deed conditions, as set out in Annexure A, on Erf 374 Green Point, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015.
b. The application for departure as set out in Annexure A, on Erf 374 Green Point, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and amend 7.1.4:
The amendment of the restrictive title deed conditions has been evaluated in terms of Section 39(5) of LUPA and Section 47 of SPLUMA and it is considered that the social benefit/public interest to the wider community and to the individual owner will not be negatively impacted on as a result of the removal and amendment of the restrictions.
