UNANIMOUSLY RESOLVED that:
a. The subdivision of erf 150157, Cape Town, into two portions measuring 2810m² (Portion1) and 3410m² (Portion 2) as per Annexure C1, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
b. The rezoning of a portion of Erf 150157 (portion 1), Observatory, from General Residential Subzoning GR4 to General Residential Subzoning GR5, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
c. The rezoning of a portion of erf 150157 (Portion 2), Observatory, from General Residential Subzoning GR4 to Mixed Use Subzoning MU2, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
d. The consolidation of a portion of Erf 150157 (Portion 2), Observatory, with Erf 163060, Cape Town, as per Annexure C1, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
e. The amendment of conditions applicable to Erf 163060, Observatory, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
f. The site development plan for the proposed development on Erven 150157 and Erf 163060, Observatory, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
g. The proposed permanent departures, for Erven 150157 and Erf 163060, Observatory, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report
