UNANIMOUSLY RESOLVED that:
a. The application for City approval for Erven 3278 and 9790, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015 in accordance with the Site Development Plans attached as Annexure C, subject to the conditions contained in Annexure A.

b. The application for the consolidation of Erven 3278 and 9790, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.

c. The application for permanent departures for Erven 3278 and 9790, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015 in accordance with the Site Development Plans attached as Annexure C, subject to the conditions contained in Annexure A.

d. The application for City agreement to permit the building to be 0m in lieu of 5m from a designated metropolitan route (Loop Street) for Erven 3278 and 9790, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015 in accordance with the Site Development Plans attached as Annexure C, subject to the conditions contained in Annexure A.

e. The application for City approval, to permit a canopy projection over the street boundary for Erven 3278 and 9790, Cape Town, be approved in terms of Section 98(b) of the Municipal Planning By-law, 2015 in accordance with the Site Development Plans attached as Annexure C, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report

Amend Annexure A:
2.2 Prior to building plan submission, the applicant shall submit elevation drawings showing design mitigation in order to create a positive interface with Pepper Street and Loop Street and to adequately screen the parking levels, which shall be substantially in accordance with Annexure C, to the satisfaction of the Authorized Official for approval



Add to Annexure A:
2.4 A servitude is required in favour of the City for the ground floor splay area which must remain open.
2.5 Sufficient stacking space (12m from the boundary line) must be provided to ensure that vehicles do not stack in the road reserve.
2.6 A servitude shall be registered for the area for which the canopy projection is required
