UNANIMOUSLY RESOLVED that:
a. The subdivision as set out in Annexure A in respect of erf 5497, Montague, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
b. The rezoning as set out in Annexure A in respect of erf 5497, Montague, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
c. The consent use as set out in Annexure A in respect of erf 5497, Montague, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
d. The application for City approval as set out in Annexure A in respect of erf 5497, Montague, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
e. The regulation departures as set out in Annexure A in respect of erf 5497, Montague, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and in discussion added the following:
7.1.5 Access to the site is considered to be problematic and an acceptable solution was not presented
7.1.6 The legitimate expectations of surrounding property owners are being negatively compromised
7.1.7 The proposal presents an inappropriate transition of built form in a limited space between the single residential properties and the stormwater detention facility.
