UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 25 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 10206 for the unauthorised land use, and such penalty be approved in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add new reason 6.4:
The gravity of the contravention is considered to be serious given the particular health and safety requirements associated with ECDs.
