Cllr R Adams stated he did not have a chance to do a site visit yet. He said that sometimes land gets leased for one purpose then residents use it for something else.
Cllr Y Adams informed the meeting that he assisted the community with this issue. He said the land in question attracts a lot of criminal activities and initiative was to curb crime in that area. He indicated that access to the land by the homeowner would alleviate the crime. He appealed to the SC to support this item.
Cllr Hendricks said that he does not have a problem with a lease as this can be cancelled after two month and supported Cllr Y Adams.
Cllr March expressed that the SC has no problem supporting the recommendation of the report and the house concurred with the Chairperson.
The house noted the content of the report and supported the recommendation of the report.
RESOLVED as follow:
It is recommended that the lease of City land comprising portions of Erven 33305, 41602, 41604 and 146744 Cape Town, situated at Birdwood Street, off Bamford Avenue show hatched and lettered ABCDEFGHJ on the attached plan SZC 1383 marked annexure A, in extent approximately 3861m², to Bamford Residents Association, or its successors in title, be approved subject to inter alia the following conditions, that:
a) A tariff rental of R2228.95 per annum excluding VAT of 14% where applicable, being R312.05 (in total – R2541) be payable.
b) The lease will endure for a period of ten years;
c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d) The property be used for gardening purposes only.
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority.
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for any improvement made to the property.
