RESOLVED
It is recommended that the lease of a portion of Unregistered State land and a portion of Erf
62305 Cape Town, situated at corner of Dolphin Way and Wetton Road, Wetton, shown
hatched and lettered ABCDEFGHJKLMNPQRS on the attached Plan130008331 marked
Annexure A, in extent approximately 709m², to Golden Rewards 2008 CC (2010/055993/23)
owner of Erf 81 Cape Town or their successor in title, be approved subject, to inter alia the
following conditions, that:
a) A market rental of R7 800 per month, inclusive of rates and excluding VAT calculated at
the rate applicable at the time of transaction be payable;
b) The rental will escalate at 6% per annum, commencing 6 months from date of valuation,
(i.e. as from 2023-05-01);
c) The lease will endure for a period of 10 years, subject to a rental review after a period
of 5 years;
d) The property be used for parking purposes only;
e) Subject to such further conditions to be imposed by the Director: Property Transactions
in terms of delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No structures will be permitted within the lease area, other than boundary fencing which
is to be of a non-permanent visually permeable boundary (palisade fencing) type and
will be subject to approval of necessary building plans in terms of the National building
regulations;
h) No compensation will be payable for any improvement made to the property;
i) Electricity services exist within the vicinity of the lease area, and the following conditions
will apply:
i. The City of Cape Town has the right to construct and/or erect and lay such poles,
stays, cables, wires or equipment relating thereto as may be necessary, together
with the right to use, inspect, maintain, repair, alter, relay and/or remove all such
poles, stays, cables, wires or equipment aforesaid. This includes the right to bring
machinery onto the property and to carry out excavations;
ii. The City of Cape Town has the right for any employee or servant or contractor of
the City of Cape Town to enter and be upon the property at any time in the exercise
of the afore said rights. Unrestricted 24 hour vehicular and personnel access to the
area is to be maintained for the purpose of accessing and maintaining electricity
services;
iii. No building, containers or structure shall be erected within 3m of the electrical
services;
iv. No excavation or filling shall be carried out within the leased area without the prior
written consent of the Director: Electricity Generation and Distribution via the
wayleave approval process. All excavations within 3m of the electrical services must
be carried out under the direction of a representative of this Department;
v. No stakes, pegs or pins shall be driven into the ground within 1m of any part of the electricity services;
vi. No plant or material shall be stored within 1m of any part of the electricity services;
vii. No mechanical plant may be used within 3m of medium voltage cable or 5m of high
voltage cable;
viii. The applicant shall not remove any boundary wall or fence common to the leased
area;
ix. The applicant shall be responsible at all times for the maintenance and good order
of the land;
x. The lease may be suspended at any time should the applicant not comply with the
conditions;
xi. On termination of the lease, the entire leased area must be reinstated at the
applicant’s expense to a condition acceptable to the City of Cape Town;
j) The premise must comply with the National Building Regulations and the Community
Fire Safety By-law, and any other applicable legislation.
k) Telkom services exist within the proposed lease area but the following conditions are to
apply:
i. As important cables are affected, it is the responsibility of the applicant to notify
Telkom immediately should the applicant locate any Telkom plant which might not
be indicated on the plan.
ii. It must be made known to the applicant that Telkom requires access to carry out
maintenance or upgrade existing plants at all times.
