It was RESOLVED that Subcouncil 15 RECOMMEND to Council that

In terms of sections 14(2)(a) and (b) of the Local Government: Municipal Finance Management Act (MFMA), Act 56 of 2003:

Council resolve that a portion of remainder Erf 118296 Cape Town, marked ABCDaefTUV, measuring approximately 2 113.02 m2, and is zoned Transport 2: Public Road and Public Parking and portions of remainder Erven 103659 and 24176 Cape Town, and a portion of Erf 1056 Pinelands, marked LMNPQRSe, measuring approximately 3 430.18 m2 and is zoned General Industrial 2, as indicated on disposal Plan LIS 2160v7 attached as Annexure A, to the report, not be required for the provision of the minimum level of basic municipal services;

Council confirm that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered;

In terms of regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R. 878 promulgated on 22 August 2008, Council approve in principle the transfer of portions of remainder Erven 118296, 103659, 24176 Cape Town, and a portion of Erf 1056 Pinelands, as described in (a)(i);

Portions of remainder Erven 118296, 103659, 24176 Cape Town, and a portion of Erf 1056 Pinelands be transferred, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.
