RESOLVED that:
It be recommended that:

The Subcouncil REVIEW AND RESCIND the decision taken on 16 August 2023
in respect of the report: Proposed Lease on a Portion of Erf 1009, Constantia, Lucius Way, Constantia for a 12 Metre Minor Freestanding Telecommunication Base Station: Rich Reward Leasing (Pty) Ltd. (20SUB9/8/2023);

The decision to support be rescinded and it be noted that Subcouncil 20 does
NOT SUPPORT the recommendation of the report attached as Annexure A:
It is recommended that the lease of a portion of City land, being a portion of
Erf 1009 Constantia, Lucius way, Constantia shown hatched and lettered
ABCD on the attached sketch marked Annexure A, in extent approximately
23.54m², to Rich Rewards Leasing (Pty) Ltd, be approved subject to inter alia
the following conditions, that:

A City approved rental of R4 770 per month excluding VAT where applicable be
payable;

The rental will escalate at 6% per annum;

The lease will endure for a period of 10 years, subject at any time to 2months’ notice of termination;
-
The proposed leased area to be used for telecommunication infrastructure
purposes only;

Subject to such further conditions imposed by the acting Director: Property
Management in terms of his delegated authority;
-
Subject to compliance with any other statutory requirements;
-
No compensation will be payable for any improvement made to the property;
-
The objections received during the public participation process not be upheld.
It is further resolved that:
The SC 20 will support the application if the applicant use alternate site, the public open space on the verge of Old Kendall Road for the Proposed Lease on a Portion of Erf 1009, Constantia, Lucius Way, Constantia for a 12 Metre Minor Freestanding Telecommunication Base Station: Rich Reward Leasing (Pty) Ltd
