In terms of section 14(2)(a) and (b) of the Municipal Finance Management Act (MFA), Act 56 of 2003:

Council resolves that Erven 5727 and 5729 Eerste River situated at 58 Mediterranean Avenue, and 6 Cardington Way, Malibu Village, in extent approximately 299m² and 298m², zoned Single Residential 1: Conventional Housing shown on the attached Plans LIS 2848 and 2849 respectively (attached to the report marked Annexure A1 and A2), not be required for the provision of the minimum level of basic municipal services;

Council confirms that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered.

In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approves in principle the transfer of Erven 5727 and 5729 Eerste River situated at 58 Mediterranean Avenue, and 6 Cardington Way, Malibu Village, as described in (a)(i).

Erven 5727 and 5729 Eerste River situated at 58 Mediterranean Avenue, and 6 Cardington Way, Malibu Village, be transferred by public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of his delegated authority.
