RESOLVED that the proposed closure and granting of in-principle approval for the transfer by public competition of city-owned improved property remainder erf 94401 Cape Town, situated at 47 New Church Street, Gardens, zoned general residential 4 (GR4) and transport 2: public road and public parking (TR2) BE DEFERRED for a site visit to obtain further information.

RESOLVED to
RECOMMEND that:
In terms of Sections 14(2)(a) and (b) of the Municipal Finance Management Act, Act 56 of 2003 (MFMA):
Council resolves that Remainder Erf 94401 Cape Town, situated at 47 New Church Street, Gardens, in extent approximately 2 377m2 and zoned General Residential 4 (GR4) and Transport 2: Public Road and Public Parking (TR2), (see Annexure A for Plan LIS 2854) attached to the report, not be required for the provision of the minimum level of basic municipal services;
Council confirm that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) has been considered;
In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations of 2008 (MATR), Council approves in principle the transfer of Remainder Erf 94401 Cape Town, situated at 47 New Church Street, Gardens as described in (a)(i);
Remainder Erf 94401 Cape Town, situated at 47 New Church Street, Gardens, be transferred by way of public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of his delegated authority;
In terms of Section 4 of Council’s Immovable Property By-Law 2015, Council approves the public place closure of Remainder Erf 94401 Cape Town, situated at 47 New Church Street, Gardens;
