It be NOTED that an application for a liquor licence received from ORGANIC POINT / SMARTIES COFFEE SHOP was considered in terms of sub-delegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended: SubCouncil 19 recommends that the application for a Consumption ON and OFF Premises Liquor Licence, reference no. LLA23040005, for the business Organic Point / Smarties Coffee Shop CONDITIONALLY SUPPORTED, subject to the following conditions:
 

  1.  The following is Imposed in terms of section 100 of the bylaw – Land Use:
    1. The tourist facility is restricted to a restaurant.
    2. The tourist facility and farm shop are restricted to the areas shown on plans drawn by Ania Wojno Architects cc with drawing numbers 100 (revision C), 101, 102, 201, 202 & 203 (all revision 0), dated 13 March 2018.
    3. The hours of operation of the restaurant and farm shop are restricted to 09h00- 18h00.
    4. No amplified sound is permitted outside of any building.
    5. No floodlighting of the parking areas is permitted. Lighting is to be low level and downwardly directed.
    6. A minimum of 50% of the products sold at the farm shop (by both weight and type of products) must be grown on the property.
 
Note: The definition of farm shop in the DMS is “a building, located on a farm, where the farmer sells produce grown on the farm and other goods to the general public.”
 
  1.   Submit a Municipal approved plan.
  2. Building additions/alterations must be done strictly in accordance with the provisions of the National Building Regulations – building plans are to be submitted and approved accordingly or provide the approved case ID number.
  3. Provide and install fire-fighting equipment as required.
  4. Provide and install SANS 1186 approved symbolic safety signage.
  5. Place required signage on an escape route.
  6. Provide escape routes compromised/non-compliant.
  7. Provide and/or install a SANS 10139 approved fire detection and alarm system.
  8. Install liquefied petroleum gas (LP gas) that comply with SANS 10087-1.
