Resolution detail

RECOMMENDED that,
 
the lease of a portion of a public street, being a portion of Erf 7000 situated at Carmichael Road, Fish Hoek, shown hatched and lettered ABCD on the attached sketch marked Annexure A, in extent approximately 72m², to Methodist Church of Southern Africa, owner of Erf 8535 or their successor in title, be approved subject, to inter alia the following conditions, that:

  1. A tariff rental of R680.00 per annum including VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
  2. The lease will endure for a period of 10 years with an option to renew for a further 10 years;
  3. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
  4. The property be used for gardening and security purposes only;
  5. Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;
  6. Subject to compliance with any other statutory requirements;
  7. No compensation will be payable for any improvement made to the property;
  8. No structures other than the existing structures will be permitted within the lease area;
  9. Any alterations or deviations to electricity services necessary as a consequence of the proposal or requested by the applicant, will be carried out at the applicant’s cost;
  10. No excavation or filling must be carried out within the area without the prior written consent of Council;
  11. The Council has the right of access at all times for the purposes of maintaining and repairing the sewer;
  12. As important cables and other infrastructure are affected, a Telkom representative must be contacted before any commencement of work on the leased land;
  13. It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which may not be indicated on the plan;
  14. Telkom requires access to carry out maintenance or upgrade existing plants at all times.
