Resolution detail

RESOLVED that:
 
It be recommended that the lease of portion of City Land, being Erf 7168 and a
portion of Erf 7097 Hout Bay situated at Moses Kontane Street, Hout Bay,
shown hatched and lettered ABCDEFG on the attached plan LT 1399v1 marked
annexure A, in extent approximately 415m², to Siyazama Educare or their
successors in title, be approved subject to inter alia the following conditions:
 
  1. A tariff rental of R1 039.13 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
 
  1. The lease will endure for a period of ten years, with an option to renew for
a further 10 years subject at any time to TWO MONTH’S notice of termination;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
  2. The property be used for Educare Centre purposes only and for no other purpose whatsoever;
  3. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property.
 
  1. Adherence to the requirements of the City of Cape Town’s water by-law;
 
  1.  Electricity services exist within the vicinity of the lease area and any alterations or deviations to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the applicant’s cost;
 
  1. Any future developments must comply with Solid Waste conditions;
 
  1. The refuse generated on the premises must be stored to the satisfaction of the Director Solid Waste Management;
 
  • Applicant must make use of all Solid Waste Services and will be responsible for cleaning of the area;
 
  1. Should the lease be cancelled or required for a road or storm water purposes, the leased area may be required to be reinstated to the original natural state, to the satisfaction of Transport Urban Development Authority Department;
 
  • Pedestrian movement shall not be negatively affected;
 
  • A land use application is required, as part of such an application the layout and space requirements including any on-site parking or stop and drop facility can be assessed.
