Resolution detail

The Chairperson introduced the report on Proposed Lease of City Land, Portion Of
Unregistered State Land, Cissy Gool Avenue, Rylands for parking purposes: Wyte
House products (PTY)LTD and asked the official to take the meeting through.
Cllr Cassiem said he would like to know if Ms. Taylor received all the detailed
objections they sent for this application and it was not only for the rezoning.Ms. Taylor said that the when they advertise it is listed in the advert and according
to the advert no objections that was received.
Cllr Cassiem said that all the objections were sent to their office from all
stakeholders.
Ms. Taylor said that they received the objections after the closing date and in the
email, they wanted details of the abutting neighbours and they informed them that
they could not send the forms to people living at the back street. She also
mentioned that the reason the application was advertised in local newspapers,
Subcouncil Office and the Ward Councillor was also for information and
comments. She further stated that it was the Subcouncil Office’s responsibility to
inform the homeowners association for comments. She said that the public
participation was done for everyone to be able to see the application and the
closing date was communicated.
Cllr Cassiem said he will not accept that because all the objections were sent to
the department and they were clear as too why they are objecting the entire
application.
Cllr Nikelo said that he would like to know if we have done our job as the
Subcouncil with this application.
Mr Daniels said that he looked at the application and it was for 2021 and that was
before we were a new subcouncil and would have to investigate the matter and
revert to the Subcouncil.
Cllr Nikelo asked Cllr Cassiem if he was aware of the application in 2021 and was
he the ward councillor at the time.
Cllr Cassiem said that he could not recall the application.
Ms. Taylor said that the application process was done in 2021 and no objections at
the received at the time, the closing date was in October 2021 and they continued
with the application as they thought there were no objections.
Cllr Nikelo said at the time of the application it was still under subcouncil 11 and
dates in the application the new subcouncil demarcations were not inaugurated the
subcouncil was not existing at the time, and this maybe the reason why some of
the information was not filtered correctly to the right department. He also said that
he would like the department to re advertise this application as we have extensive
evidence of the objections for this application and would like those objection to be
sent to the right department and all comments be sent to the officials before the
closing date.
Ms. Taylor asked if the whole process should be done again.
Cllr Cassiem proposed that the item be deferred. Cllr Adams seconded the
proposal. Cllr Adams seconded the proposal.
Cllr Nikelo said that would be appreciated, as all parties involved will be able to
comment and give input.There were unanimous agreement with the resolution.

That the Proposed Lease of City of Cape Town, Portion of unregistered state land,
Cissy Gool Avenue, Rylands for Parking purposes: Whyte House Products (PTY)
LTD BE DEFERED with comments made by councillors.
