It is recommended that: It be NOTED that an application for a liquor licence received from MADUNE'S PLACE was considered in terms of sub-delegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended:
Subcouncil 10 recommends that the application for a Consumption ON Premises Liquor Licence, reference no. LLA23030021, for the business Madune's Place NOT BE SUPPORTED, because of the following reasons: The subject property, namely ERF 2970, Khayelitsha, 52 Sitofile Street, (Madune’s Place) is zoned Single Residential 2 (SR2). The sale of alcoholic beverages (on-site consumption) is not a permitted use in the SR2 zone. Therefore, the proposed application for liquor licence is not supported. A land use management application is required for a temporary departure in terms of Section 42(c) of the Municipal Planning By-Law, 2015, in order to permit the sale of alcoholic beverages (on-site consumption) on the subject property. |
