It is recommended that:
It be NOTED that an application for a Section 36 New Liquor application was received from HOËRSKOOL STRAND – LLA23040001 was considered in terms of sub-delegated authority on Friday, 12 May 2023 and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended:
Subcouncil 08 recommended that the application, reference no. LLA23040001, for HOËRSKOOL STRAND, BE NOT SUPPORTED for the following reasons:
Circular 20190530-5299 of the Western Cape Department of Education, for the sale and consumption of alcoholic liquor on school premises or at school activities and the presence of learners when alcoholic liquor is consumed or sold on school premises or at a school activity, provides guidelines and conditions which should be considered if a liquor licence application from a school is received.
As an institution of education, the Head of the Department of Education may consider applications received from schools and grant authorisation, valid for one specific academic year (12 months), to the school for the consumption or sale of alcoholic liquor on school premises or at a school activity. In this regard, schools should annually indicate relevant events or planned school activities where alcohol beverages will be sold or consumed on or off school premises.
The applicant in this case, should submit an event liquor licence application to the Western Cape Liquor Authority for each event, which must be accompanied by the Head of Department’s letter of authority, together with a letter from the principal or the chairperson of the governing body, as the case may be, indicating that permission has been granted for the staff function or school activity in question.
